Service Agreement
Complete Visa Assistance / Complete Visa Assistance PLUS
This Agreement is entered into between:
- VisaServices.org Inc (trading as Visas.pt), a Delaware corporation ("Company")
- The purchasing client ("Client")
By purchasing a package, the Client agrees to all terms below.
1. Scope of Services
The Company provides structured visa and relocation support for Portugal.
1.1 Complete Visa Assistance
Includes:
- Identification of the most suitable visa based on Client profile
- NIF (Portuguese tax number) assistance
- Portuguese bank account setup assistance
- Full document checking and preparation guidance
- Step-by-step application support
- Visa appointment guidance (VFS / Consulate)
- Unlimited email support during the process
- Video consultations with in-house Portuguese immigration lawyers based in Portugal
- Ongoing support responding to any requests for additional documents or clarification from VFS Global, consulates, or AIMA, including clear guidance on how to prepare and submit the required information
These services are designed to reduce errors and improve application quality.
1.2 Complete Visa Assistance PLUS
Includes everything in Complete Visa Assistance, plus:
- Property finder support (up to 10 options)
- Rental or purchase guidance aligned with visa requirements
- Tax consultation with a Portuguese tax expert
- AIMA appointment filing and scheduling
- Attendance support for AIMA interview (where applicable)
- Extended support through post-visa stages
- Full support throughout the residency stage, including handling and responding to any requests for additional documents or clarification from AIMA, with clear guidance on preparation and submission
- Priority handling of AIMA follow-up requests to help reduce delays
1.3 Legal Team Structure
- All legal support is provided by in-house Portuguese lawyers
- Lawyers are based in Portugal
- Legal work is not outsourced to third-party firms
This ensures consistency and direct coordination throughout the process.
1.4 NIF and Bank Account Disclaimer
- NIF (Numero de Identificacao Fiscal) issuance is subject to approval by the Portuguese tax authority
- Portuguese bank account opening is subject to approval by the selected financial institution
The Company provides guidance, preparation, and coordination only.
The Company does not:
- Guarantee approval of a NIF application
- Guarantee approval of a bank account application
- Control decisions made by tax authorities or financial institutions
The Client acknowledges that:
- Additional documentation may be requested by authorities or banks
- Processing times and outcomes are outside the Company's control
2. Nature of Service
- The Company provides guidance, coordination, and access to professionals
- The Company does not act as a government authority
- The Company does not control visa decisions
The Client acknowledges this is a professional support service, not a guaranteed outcome.
3. Payment Terms
- Full payment is required upfront before services begin
- No work will start until payment is received in full
- Bundled package pricing includes discounted rates compared to purchasing services individually
If the Client prefers staged or pay-as-you-go services:
- The Client should select the "Do It Yourself" option instead
- Individual services are priced separately under that model
All payments are final, subject only to Section 6 (Refund Policy).
4. Client Responsibilities
The Client must:
- Provide accurate and complete information
- Submit all required documents on time
- Follow the Company's guidance
- Attend required appointments (VFS, Consulate, AIMA)
- Respond promptly to communication
Failure to do so may:
- Delay the process
- Reduce chances of approval
- Void refund eligibility
- Void eligibility for reapplication support (Section 7)
5. No Guarantee of Outcome
- Visa approval is decided solely by Portuguese authorities
- The Company does not guarantee approval
This includes, but is not limited to:
- Visa approvals
- NIF issuance
- Bank account opening
The Client accepts full responsibility for the final outcome.
6. Refund Policy (Stage-Based - Model B)
Refunds are based strictly on work completed.
6.1 Full Refund
- Available only if cancellation occurs before any work begins
6.2 Partial Refunds
- 75% refund after onboarding but before document review
- 50% refund after document review and initial guidance
- 25% refund after substantial application preparation and support
6.3 No Refund
No refund applies if:
- Application has been submitted
- Visa appointment has been scheduled or attended
- AIMA process has been initiated (PLUS package)
- The Client becomes unresponsive
- The Client fails to follow advice
- A visa is refused for any reason
- Work has been substantially completed
6.4 Third-Party Costs
The following are always non-refundable:
- Government fees
- Consulate or VFS fees
- Legal or third-party service costs for document certification, apostille/legalisation, translations, or similar external services
7. Reapplication Support (Conditional)
If the Client's visa application is refused, the Company may provide support for one additional application under an alternative visa type.
This is a limited and conditional support feature that goes beyond the standard approach used by most visa service providers, who typically do not provide structured support after a refusal.
7.1 Eligibility
The Client qualifies only if:
- All Company guidance was followed
- All required documents were submitted correctly and on time
- All required appointments were attended
- The refusal was not caused by missing, incorrect, or misleading information
7.2 What Is Included
- Reassessment of the Client's situation
- Identification of a stronger or alternative visa pathway
- New application strategy
- Document review for the new application
- Step-by-step guidance for resubmission
7.3 What Is Not Included
- Government or consulate fees
- Third-party or legal costs
- Services outside the original package scope
- Multiple or unlimited reapplications
7.4 Limitations
- Support is limited to one additional application only
- The Company will proceed only if a viable alternative visa pathway exists
- The Company reserves the right to decline reapplication support if no suitable option is available
8. Service Delivery
- Services are delivered remotely via email, video calls, and digital tools
- Lawyer consultations are scheduled based on availability
- Timelines are estimates only and depend on external authorities
9. Limitation of Liability
- The Company is not liable for visa refusals or delays
- The Company is not responsible for decisions made by authorities
- The Company is not liable for incorrect or incomplete Client information
Maximum liability is limited to the total fee paid.
10. Termination
The Company may terminate services if:
- False or misleading information is provided
- The Client fails to engage in the process
- The Client does not follow critical instructions
No refund applies in these cases.
11. Governing Law and Dispute Resolution
This Agreement is governed by the laws of the State of Delaware, United States.
Any dispute arising out of or in connection with this Agreement shall be resolved exclusively in the courts of the State of Delaware.
The Client agrees to submit to the jurisdiction of these courts.
12. Acceptance
By purchasing a package, the Client confirms:
- They understand what is included
- They accept upfront payment terms
- They understand bundled pricing includes a discount
- They understand refunds are limited and stage-based
- They understand reapplication support is conditional and limited
- They accept that approvals (visa, NIF, bank) are not guaranteed
