Current State of AIMA Processing in 2026

In 2025, AIMA issued about 386,000 residence permits. That represented roughly a 60% increase over 2024 levels. Officials state that around 93% of pending cases have been cleared. The agency employs more than 770 staff members.

Service quality issues are still reflected in the complaint statistics for 2025. Complaints logged on the national portal rose by about 6.4%. Most relate to administrative errors, technical failures and unanswered contacts. Temporary residence permit appointments can take place months after visas expire.

‎ New AIMA Rules Affecting Your Application

Since April 28, 2025, AIMA has only accepted residence permit applications that are fully complete at submission. Any application missing even one required document faces immediate rejection. This applies to both new applications and renewals under Law 23/2007 and Regulatory Decree 01/2024.

End of Automatic Extensions

Portugal ended automatic extensions for expired residence permits on October 15, 2025. A six-month grace period now applies after your permit expires. You must carry your expired card and proof of submission of your renewal application during this period.

For permits that expired on or before June 30, 2025, validity extends to April 15, 2026. Failure to apply within the grace period results in loss of legal status.

Online Renewal Options

AIMA enabled online renewals for permits expiring in January and February 2026 through their portal. You must update your address and Social Security Number before submitting to avoid processing delays.

Citizenship Law Status: 2026 Update

Portugal’s revised Nationality Law, published as Organic Law Nº 1/2026, entered into force on May 19, 2026. For citizenship through residence-based naturalisation, the minimum legal residence requirement is now 7 years for nationals of Portuguese-speaking countries and EU member states, and 10 years for nationals of other countries.

The previous 5-year residence requirement remains applicable to qualifying citizenship applications already pending when the new law entered into force. New applications are subject to the revised rules, including additional requirements concerning knowledge of Portuguese culture, history, national symbols and civic responsibilities.

Why Do AIMA Delay Violate Portuguese Law?

AIMA must process residence permit applications within legally prescribed timeframes. When the agency fails to meet these deadlines, it breaches Portuguese administrative law. Article 66 of the CPTA provides legal remedies against administrative silence.

This legal mechanism does not influence whether your permit gets approved. It compels AIMA to fulfill its legal obligation to make a decision on your application.

  • Step 3: Preliminary Request to AIMA

Portuguese law requires a written request to AIMA before filing a court action. We prepare and submit this documentation properly.

  • Step 4: Court Filing and Representation

Your immigration lawyer in Portugal files the legal action and handles all court communications. You do not need to appear in person. The entire process can be handled remotely.

Important: Lawsuits must be filed individually for each applicant. Couples and families require separate cases for each person.

Filing Deadline You Cannot Miss

There is a one-year deadline for filing legal action against AIMA. This period starts when AIMA's legal deadline for making a decision expires. Missing this window eliminates your access to this judicial remedy. Contact a lawyer immediately if your case has stalled.
